Starting point fixed at four years three months imprisonment based on role in a conspiracy to import a very large quantity of cocaine but a lower level functionary role; applied 20% (ten months) discount for guilty plea and a further eight month reduction for s27 report mitigation; no credit for 84 days on EM bail because of breaches; resulting sentence two years nine months imprisonment.

The High Court held there was no error in the District Court Judge's exercise of sentencing discretion: the starting point and discounts were defensible, the Judge properly balanced rehabilitation and public safety, and home detention, while potentially available, was not appropriate absent a confirmed residential rehabilitation address and given the appellant's high risk of reoffending; appeal dismissed.

The Court granted extensions and admitted the s 27 reports, held the eight-year starting point was within the appropriate Mako-guided range, concluded uplifts for historical previous convictions were unjustified, adjusted discounts for personal circumstances (20% for Wilson; 25% plus six weeks for Poi), quashed the imposed MPIs as unnecessary, and quashed and substituted the sentences to 6 years 7 months for Wilson and 5 years 10 months for Poi.
