Woodhouse J's interlocutory setting-aside did not preclude a fresh summary judgment application, but the affidavits and accounting records produced by Green Grass Ltd were sufficiently credible and capable of showing consideration for the payments so as to constitute an arguable defence; accordingly summary judgment was dismissed.
