Section 317(1) does not preclude a court imposing reparation as part of a criminal sentence because a prosecution is not a 'proceeding for damages'; s 32(5) of the Sentencing Act excludes only compensation actually payable as entitlements under the Compensation Act, so courts may order reparation to top up loss of earnings not compensated by that Act.
