Section 317 bars compensatory damages claims in New Zealand courts where the claimant has ACC cover irrespective of where the conduct occurred; furthermore the 25 New Zealand claimants were privies to the English sample litigation so are estopped from relitigating the same issue in New Zealand and continuation would amount to an abuse of process.
