The Court found on the evidence that the 2004 BMW X5 and the $1,000 cash were tainted property or, alternatively, that profit forfeiture was available because the respondent had obtained benefits from drug offending equal to or exceeding their value; accordingly asset forfeiture orders were granted and forfeiture would not produce undue hardship.

The union (MUNZ) had standing under s137(4) to seek enforcement orders alleging inconsistency under s61; the correct test for inconsistency is an objective comparison of the terms of the additional agreement with the terms and conditions of like employment in the collective agreement, and on that comparison the fixed term AA agreements were inconsistent with the collective agreement; the appeal is dismissed.

The court found there was sufficient untainted evidence to establish the 1986 dump truck rollover and associated neck/back injury; the respondent was not prejudiced in its ability to make decisions because further expert opinion could address causation, therefore ACC was wrong to decline the late claim under s61(2) and the appellant is entitled to cover for the 1986 accident (with entitlements to be determined by ACC).
