The High Court held the Environment Court did not err in law: it took into account Treaty principles within the statutory limits of the RMA, properly assessed and weighed the s274 parties' evidence (weight is a factual matter not a legal error), and reasonably concluded that the adaptive management conditions reduced the scientific risk of a permanent ecological flip to an acceptable level, so the consents could be granted; appeal dismissed.
