Both judicial review proceedings were struck out: the first was moot or disclosed no reasonably arguable cause given that withholding errors were rectified and remaining complaints were trivial or for the inspectorate; the second was untenable because the deprivation of a mattress was caused by the applicant's own destruction of provided mattresses and thus justified; plaintiff permitted to replead the first proceeding as a NZBORA damages claim.
