The appellant is deemed covered by the 1992 Act under s.135; Inland Revenue records demonstrate he was self‑employed in the 12 months immediately before the commencement of incapacity (found to be 5 February 1993); therefore s.41 applies to calculate weekly earnings and not s.40 or the 1982 Act; the review officer's decision that s.41 governs the assessment is confirmed and the appeal is dismissed.
