Section 52A must be interpreted in line with established authority requiring conviction of a prior offence before treating later offending as second or subsequent; because the three offences were committed before conviction of any prior s52A offence they each qualified as first offences under s52A(3) attracting mandatory six‑month disqualifications that cumulatively yield 18 months; the two‑year disqualification was therefore erroneous and was quashed and replaced with an 18‑month disqualification commencing 4 October 2019.

SURMAN v NEW ZEALAND POLICE [2023] NZHC 933

The Court concluded the appellant did not demonstrate that threats by her partner so compromised her free will as to vitiate the guilty plea: she received consistent legal advice, had repeated opportunities to alter or vacate the plea, repeatedly accepted possession in earlier statements, and her later account conflicted with contemporaneous evidence; therefore no miscarriage of justice arose and the conviction stands.
