The District Court applied the correct sentencing methodology (per Moses), the discounts for addiction, rehabilitation, EM bail and reparation were within the available range given the offender's circumstances, the additional evidence was not fresh and added nothing material, and the overall sentence was not manifestly excessive; appeal dismissed and sentence upheld.

The Court held the District Court judge did not misapply Moses; however the judge erred in failing to provide a discrete remorse discount supported by the facts and report inconsistencies, and on resentencing the proper application of stage two adjustments produced a substituted sentence of 20 months' imprisonment.

The District Court erred by failing to perform the second step of the Moses methodology and by not applying discrete offender-based discounts for mental impairment, personal deprivation and youth; applying discounts of 10% (mental impairment), 10% (personal deprivation) and 5% (youth) together with a 25% guilty plea discount to the adjusted starting point reduced the end sentence from four months to two and a half months imprisonment, cumulative on the existing sentence.

The Court upheld the High Court's 23-year starting point as not erroneous, rejected adoption of the Modified Discount Methodology, awarded a two-year reduction for early guilty pleas and a separate three-year reduction for personal mitigation (youth, mental health history, lack of prior convictions), resulting in substitution of the MPI from 20 years to 18 years.

The High Court found no error in the District Court's approach: use of Nuku as guidance for starting point was permissible, the uplifts for related offending and prior convictions were justified, and the combined adjustments including a 15% guilty plea discount produced a final 28‑month sentence that was within the available range and not manifestly excessive; appeal dismissed.

The Court held the starting point for this aggravated robbery was appropriate, the full 25% guilty plea discount was properly allowed, the additional deductions for bail conditions and personal mitigation were within reasonable bounds, and the 32-month sentence was not manifestly excessive; therefore the appeal is dismissed.

The High Court held the District Court's starting point and 16 month sentence were within the appropriate range given the gravity, recidivism and aggravating features (high breath reading and breach of release conditions) and that the sentencing process did not produce a manifestly excessive outcome; only the unrelated post-release travel restriction was improperly imposed and was deleted.
