Preventative detention was imposed because the defendant displayed a pattern of serious sexual offending, the offences caused profound harm, expert reports assessed his sexual recidivism risk as well above average, prior interventions had not addressed sexual offending, substance abuse was a significant trigger, and a finite lengthy sentence plus ESO would not provide adequate protection; therefore s87 criteria were satisfied and preventative detention with a minimum period equal to the calculated finite sentence (7 years 8 months) was required.
