The phrase 'the date of the giving by the Tribunal in writing of the decision' in s 123(4) means the date the decision is given to the parties; because the appellant did not receive the Tribunal's emailed decision on 15 April 2021 (and a later screenshot did not amount to giving the judgment), the appeal was not out of time under s 123(4) and should be listed for directions to progress the appeal.
