Given the death, incapacity and resignation of former trustees, the lawful appointment of a replacement trustee, adequate service on interested parties and absence of any defence or objection, it was expedient under s 52 Trustee Act 1956 to vest the registered land in the current trustees; default judgment was appropriate where no defence was filed.

Because there was no person able to oppose the relief (the caveat had been withdrawn and no defendant or other party opposed) and the Associate Judge's review supported the relief, the Court had authority to and did enter judgment in terms of paragraphs (a) and (b) of the plaintiffs' statement of claim.

The Court found on the evidence that Gate Pa, Golden Eagle and Shahenshah, together with the Osman directors and others, acted in concert to fraudulently manipulate Veda credit information to induce the plaintiffs to advance funds; the means were independently unlawful, caused quantifiable loss, and therefore judgment is justified against those defendants for the proven loss, assessed at $6,865,761.32, joint and several, plus costs.
