The court found the requirements of r 6.8 were satisfied because reasonable attempts at personal service had been made, the debtor was aware of the proposed service and refused to cooperate, and substituted service by leaving the documents at the residence combined with sending a full image of the bankruptcy notice by text message was likely to bring the notice to the debtor's attention; therefore personal service was dispensed with and substituted service authorised, with service deemed to occur two working days after transmission of the text.
