The High Court held that the appellant provided qualifying services and that the deceased made an objectively inferable promise (corroborated by the 18 July 2003 Will) with a sufficient nexus to the services; the promise was not fully fulfilled by the benefits the appellant received by survivorship and under later wills, and, exercising the statutory discretion and netting off reciprocal benefits, the Court awarded the appellant an additional NZD 100,000 and made specified costs directions.
