Leave to appeal was refused because the Court was not satisfied it was necessary in the interests of justice: the prospect that a res judicata estoppel would arise was speculative, the law on s 290 is settled and not of general commercial significance, and there was no real risk of substantial miscarriage of justice if the appeal were not heard.
