The statutory demand was set aside because the initial Payment Claim was invalid due to a materially incorrect due date combined with cumulative errors (incorrect payee name and misleading partial notice), the statutory demand overstated the amount due (payments not credited and interest not legally claimable without prior quantification), and there was a genuine dispute about liability for the fan motor repairs; accordingly the demand could not stand.
