The 7 May 2010 email was objectively an offer to waive costs only if all outstanding rates and penalties as at that date were paid; Mr Newman had not paid the full outstanding sum by 21 June 2010 when the Council sought costs, so there was no concluded settlement and the District Court erred in quashing the costs orders; the costs orders were therefore reinstated.
