The application to set aside sealing was dismissed because Mr Stewart failed to identify any duty breached or provide probative evidence of fraud and the judgment based on his admission stands; the subsequent proceedings were struck out because they were a collateral attack barred by res judicata and the Settlement Deed, contained unparticularised and unsupported allegations of fraud, and improperly joined KPMG, thus constituting an abuse of process.
