The application for extension of time and for a stay was dismissed because HDHL failed the threshold requirement of demonstrating an arguable defence pursued with genuine intent, was presumed insolvent under the statutory demand, and its dilatory conduct risked wasting assets and prejudicing the creditor; for the same reasons a stay was refused.
