The Court approved the parties' agreed Tomlin Order and stayed all further proceedings except for the purpose of carrying the agreed terms into effect, granting leave to the plaintiff to apply as to carrying those terms into effect.

The caveat achieved its protective purpose by enabling implementation of the settlement; respondents are not the successful parties for costs purposes and no justification exists for an award of costs or indemnity costs against the applicant, therefore each party must bear their own costs.

The court has jurisdiction under Rule 476C to order costs for the period between the end of the settlement and the actual filing of the discontinuance because the defendants had not agreed to waive costs for that intervening period; exercising its discretion, the court awarded $300 to the defendants.
