On the evidence the Court found no binding settlement was communicated on 16 July 2014; Auckland Transport was entitled to some 2B costs but not the full amount claimed because several steps were unnecessary or primarily served to keep the adjudication alive for the creditor's benefit; the adjudication application was struck out because the underlying debts were satisfied and the Court declined to grant an adjournment to keep the proceeding alive; consequentially reduced costs were ordered and trust funds applied.
