The Crown proved beyond reasonable doubt that Robertson controlled the relevant funds and repeatedly induced clients to provide money to be traded or to buy shares while he did not intend to trade or to transfer beneficial value; consistent independent complainant testimony, staff admissions that trading-on-behalf required Robertson's authority, contemporaneous bank and text records, absence of required share transfer formalities and retrospective creation of paperwork after regulator contact established knowledge, intent to deceive and dishonesty for the charges proven.
