The smoking room is an "internal area" within a building occupied by the employer and is "usually frequented" by employees in the course of their employment; as a common internal area attached to the cafeteria it falls within the statutory definition of "workplace" in s 2(1), so permitting smoking there breached s 5(1); consequently the appeal is dismissed.
