The respondent had the obligation to identify and deliver all material within the ordered timeframe, did not have reasonable grounds for delay, the receivers were justified in filing the arrest application which prompted compliance, and a costs award on a Category 2B scale uplifted by 50% plus disbursements was appropriate rather than indemnity costs.

The contractual terms and invoice endorsements entitled the respondent to solicitor/client costs; the existence of one invoice predating 4 December 2009 did not materially affect the costs of the litigation, so the contractual indemnity applied to the claim as a whole and indemnity costs of $7,980.26 were awarded together with disbursements.
