Clause 14 of the settlement agreement expressly allocated recovery costs to the plaintiff; the High Court Rules allow contractual entitlement to solicitor and client costs, the respondent produced invoices and there was no challenge from the appellant, therefore solicitor and client costs were awarded in accordance with the contract.
