The Court concluded the Corporation did not have a sufficient evidential basis to be 'not satisfied' that Mr Beck's entitlement had ceased because the weight of multidisciplinary and treating expert evidence (particularly Dr Newburn and earlier treating specialists) showed ongoing physical/neurological effects attributable to the 1999 head injury; therefore the suspension was unlawful and entitlements must be reinstated.
