The initial spinal accessory nerve injury was an ordinary consequence of the neck surgery and not a treatment injury, and there was no failure to diagnose or treat the nerve injury by the surgeon or the general practitioner prior to 2 August 2012 such that the appellant lost a viable treatment opportunity; therefore the appeal is dismissed.
