On balance the Court declined to order separate preliminary questions because demarcation difficulties, the integrated and fact‑dependent nature of tikanga/ahi kā/mana whenua issues, the novelty of the legal questions, the risk of inadvertent findings and multiple appeals made a single substantive trial the most appropriate and expeditious course; Marutūāhu should be joined as a defendant and wider service on affected iwi/hapū ordered.
