The court found on the balance of probabilities that the appellant’s current symptoms were caused by the now symptomatic pre-existing spondylolithesis at L5/S1, not by ongoing effects of the 1996 back strain, and therefore confirmed the respondent’s suspension of entitlements for the lower back condition.
