Sections 268 and 269 of the Property Law Act 2007 constitute general principles in part 4 that the Tenancy Tribunal may apply under s 142(2) of the Residential Tenancies Act 1986 where not inconsistent with the RTA; accordingly residential tenants are exonerated from liability for carelessly caused loss or damage to premises to the extent provided by ss 268–269 but remain liable for intentional damage.
