The trial Judge did not err in assessing the evidence: the expert could not determine impact point and offered no forensic preference; direct witness evidence (Mr Chrustowski and independent witness Boswell) was credible and corroborative that the appellant entered or was in the southbound centre lane; on the facts the prosecution proved beyond reasonable doubt that the appellant carelessly injected himself into busy southbound traffic and caused the collision; appeal dismissed.

The appeal was allowed because the trial judge's oral reasons showed he convicted by preferring the prosecution account over the defendant without demonstrating independent satisfaction that the charge was proved beyond reasonable doubt; that failure created a real risk the trial outcome was affected and the appropriate remedy was to remit the matter to the District Court for retrial under s233(3).

Although the defendant was likely involved, the circumstantial evidence (vehicle associations, undatable fingerprints, CCTV sighting seven hours later, later driving of stolen vehicle) did not, as a matter of law, exclude the reasonable possibility that the defendant was only generally associated or not present during the robbery; therefore no properly directed jury could be sure of guilt beyond reasonable doubt and the defendant must be discharged under s147.

The trial judge lawfully applied Evidence Act provisions in excluding a dock identification and in controlling re‑examination, and his findings that the prosecution failed to prove identification and other elements beyond reasonable doubt were open on the evidence; no miscarriage of justice was shown to justify ordering a new trial.
