The Court held that documented SOPs and maintenance of a controlled drugs register are conduct directly incidental to a pharmacist's statutory scope of practice and may amount to malpractice under s100(1)(a); the Tribunal was entitled to find misconduct (both malpractice and conduct bringing the profession into disrepute) but committed procedural error by treating charges framed in the alternative as cumulative for penalty; cancellation was disproportionate on these facts and suspension or other significant sanction should be reconsidered with submissions.
