The Court was satisfied Westpac established a prima facie case on signed loan and overdraft agreements, evidence of default and proper substituted service of the Property Law Act notice which expired unremedied, permitting lawful acceleration of the loans; Mr Bateman failed to advance an evidentially supported arguable defence on service or any other pleaded ground, therefore summary judgment was entered for Westpac for the specified principal sums with contractual default interest, costs to be determined.
