Thomson Wilson was granted leave to be substituted as plaintiff because it had been granted leave to appear on 12 May 2014 and r 31.24(4) permits substitution on the adjourned hearing date; the company was clearly insolvent and there was no proper discretionary basis to refuse a liquidation order; accordingly a liquidation order was made conditional on filing prescribed forms and a liquidator was appointed.
