The proceeding was struck out because the applicant is an undischarged bankrupt whose property and any rights to commence proceedings in relation to that property vested in the Official Assignee under the Insolvency Act 2006 s101; therefore the applicant lacked standing to seek PPPR Act property orders regarding his 'estate', the 'double/split person' theory has no legal effect, and the proceedings constituted an abuse of process warranting dismissal and a three‑year limited restriction order under ss166–167 Senior Courts Act 2016.
