Because summary judgment was entered in favour of Spinnaker, the debtor withdrew opposition and the court could properly substitute Spinnaker (and Reesby, with withdrawn opposition) as judgment creditors under s 44; accordingly costs are payable under r 14.2 and 2B scale is appropriate.
