On the balance of probabilities the appellant failed to prove ongoing incapacity from 30 March 2000 (the date required to show he was an earner immediately before incapacity) and lacked the necessary medical certification after that date; although specialists identified incapacity at the time of later examination, that incapacity occurred when the appellant was no longer an earner, so he does not meet Clause 7 Schedule 1 and is not entitled to weekly compensation; appeal dismissed.
