On the balance of probabilities the March 9 2011 event caused further injury to Mr Turner’s lumbar spine leading to the disc protrusion that necessitated surgery; the treating surgeon's opinion was preferred over the CAP panel where cumulative effect of prior injuries and the 2011 event had not been given sufficient weight, therefore ACC is liable to fund the surgery.
