Appellant failed to prove on the balance of probabilities that her lumbar disc degeneration was caused by the regular lifting and nursing tasks (s.7(1)(a)); medical evidence was inconclusive and did not establish occupational causation, and evidence did not establish that nurses face a significantly greater risk of developing spinal degenerative disease (s.7(1)(c)); accordingly the respondent's declination of cover was upheld and the appeal dismissed.
