The Supreme Court granted leave to appeal directly because exceptional circumstances existed: the legal question of whether s104(1)(a) permits consideration of climate change effects from end use greenhouse gas emissions is of public importance and an early final determination was necessary to avoid disruption to ongoing Environment Court proceedings; the approved ground of appeal is the interpretation of s104(1)(a) RMA on that issue.
