Section 9 is properly interpreted to allow registration following non-custodial sentences for qualifying offences including possession of child pornography where, on consideration of the s9(3) factors, the offender poses a sufficient ongoing risk to the sexual safety of children; on these facts the judge correctly found a medium risk of reoffending and properly exercised his discretion to order eight years' registration.
