The High Court held the Tribunal erred by importing the criminal standard and over-weighting public 'accountability' in applying s95 HPCAA; given the Tribunal declined suspension, accepted rehabilitation and there was expert evidence of material risk to the practitioner's health and family, permanent non-publication of the practitioner's name and identifying details was 'desirable' and warranted. The Court quashed the Tribunal's refusal and ordered permanent name suppression.
