The Court was not satisfied the respondent proved on the balance of probabilities that the appellant's ongoing back condition was exclusively caused by degeneration/ageing; the absence of nerve root compromise on imaging, the substantial clinical improvement after soft tissue injections, and the inability to conclusively link degenerative changes to this pain meant the cancellation under s117 was not justified and the 22 February 2006 decision was quashed, entitlements restored.
