The proceeding was struck out because it did not identify any exercise of a statutory power subject to judicial review and, on its face, constituted a plain abuse of the court's process; accordingly the claim was struck out under the High Court Rules.

The Court held the impugned letters were preliminary investigatory steps that did not justify judicial intervention; absent a sufficiently influential or final decision or a procedural error likely to materially affect the ultimate outcome, the Court will not entertain premature review where adequate remedies and further opportunities to correct errors exist.
