The Minister's insertion of chapters 12A and 22 into the Canterbury Regional Policy Statement and the revocation of Proposed Change 1 were not exercised in accordance with the purposes of the CER Act, constituted a misapplication of s27 by circumventing the Recovery Strategy/Plan processes and statutory safeguards, were not reasonably necessary under s10(2), and unlawfully deprived parties of access to the Environment Court; the decisions are set aside.
