Balancing the interests the Court held that a modest, tangible security should be ordered: Nathans' claim against Staples Rodway is arguable and responsibly brought but Nathans is impecunious and represents many small investors who cannot practically provide security; full security would extinguish a meritorious claim, but defendants deserve some protection; therefore security of NZD 75,000 to be paid into Court by a specified date was appropriate.
