The Court, applying the Court of Appeal three-step process and satisfied on evidence that the Mayfair Villas were damaged, that MBIE had approved the repair scope and contributed funding, that owners had approved the draft scheme and there was no opposition, ordered settlement of the proposed reinstatement scheme under s 74 of the Unit Titles Act 2010.
