The Education Act 1989 and the Code prevail over any inconsistent private enrolment contracts; TBC acted unlawfully in expelling/excluding students for off‑campus conduct outside the Act's disciplinary scope, the IEAA had jurisdiction to reach those conclusions under the Code, and although the IEAA breached procedural fairness by not giving TBC an opportunity to comment on adverse findings, the Court declined to quash the IEAA decision because the outcome was legally correct and no prejudice justified overturning it.
