The Court held that the appellant failed to prove on the balance of probabilities that a cervical spine injury was caused by the 30 April 2002 accident; there was no medical certification of increased impairment for the lumbosacral injury to permit reassessment; and informal communications in 2008 and 2013 did not constitute a properly lodged claim triggering deemed cover under s58; accordingly the appeals are dismissed.
